Retainers, Deposits, Payments
The date of the event is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the cake, delivery charges, equipment deposit, and a signed contract (invoice payment).
The final payment is due 5 days prior to pickup or delivery.
If the client fails to make payments, Kaystries will cease work, the order will be canceled and no refund will be given.
Payments are made only through invoices sent by Kaystries and payments made through sent invoice is an agreement to Terms and Conditions.
Liability
Kaystries is not responsible for any damage to the cake or shortage of cake caused by anyone NOT employed by Kaystries.
Kaystries will not deliver a cake/ treats or allow for pickup if payments have not been paid in full.
Fulfillment of Contract
Kaystries is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Kaystries control.
If Kaystries has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 75% of the total cost.
Once the Client receives the cake, Kaystries no longer assumes any responsibility for damage caused to it.
Postponement/Cancellation
The Client must notify Kaystries if there is a change in the date of the event or a complete cancellation.
If a cancellation or rescheduling occurs 14 days prior to the date of the event, all money will be refunded as credit minus the retainer's fee.
If a cancellation or rescheduling occurs after 13 days prior to the event, 0% will be refunded as credit including the non-refundable retainer's fee.
Changes to Order
Any changes must be submitted 14 days in advance.
There will be no changes allowed 13 days prior to the event.
Design of the Cake
Kaystries will follow the client’s requests closely to create the cake desired and agreed upon as stated on the invoice.
Kaystries cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar.
Serving Amount & Sizes
The serving size is roughly 1.5 inches wide x 2 inches long
Serving size estimations are not guaranteed to be exact.
Kaystries is not responsible for a shortage of cake if the pieces are cut too large.
Allergy & Dietary Warnings
Kaystries baked goods may have come in contact with the following ingredients:
Nuts
Gluten
Dairy
Soy
Natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color, and other allergens are not listed.
The client is responsible for pointing out to guests potential allergy hazards.
Kaystries is not responsible for dietary and allergens, however will take all precautions possible.
Kaystries may use “non-toxic” dust/decor to achieve desired design/colors. This may not be approved by FDA however won’t harm if consumed. VERY minimal amounts are used and are often easy to remove/peel off.
Delivery and Set-Up
Kaystries is not responsible for tardiness if the venue is changed within 48 hours of the event.
The client may pick up the cake. The client assumes liability once cake passes into the Client’s possession or to client’s pickup recipient.
The client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting).
Kaystries is not responsible for mishaps to the cake (melting, bulging, rounding, cracking, etc.) if not properly stored at ideal temperature (not above 70 degrees) and placement.
Photographs
Kaystries reserves the right to use all photographs of the cake for advertising purposes.
